Partner and Fiancé Visa
PARTNER (820/801) VISA
This partner visa is for applicants who are in Australia (onshore).
General Requirements:
- Either validly married to or in a de facto relationship with an Australian citizen or permanent resident or an eligible New Zealand citizen.
- Marriage must be valid under Australian law
- De facto relationship must be for at least 12 months subject to exceptions
- Relationship is genuine and continuing and satisfies the 4 relationship pillars
Temporary Partner (820) Visa applicants/holders can:
- Stay in Australia until a decision is made on your permanent Partner (801) visa application
- Work and study in Australia
- Access Medicare
Permanent Partner (801) Visa holders can:
- Stay in Australia indefinitely
- Work and study in Australia
- Apply for Australian citizenship after 4 years’ residence
- Sponsor eligible relatives for permanent residence
Two years after lodging an 820 Temporary Partner visa application, the 820 visa holder may be eligible to apply for a Permanent Partner (801) visa.
PARTNER (309/100) VISA
The applicant for the 309 (Temporary) Partner visa must be outside Australia at the time of application and visa grant. The applicant for the 100 (Permanent) Partner visa can be in or outside Australia at the time of application and visa grant.

- Marriage must be valid under Australian law

Partner (Provisional) 309 Visa holders can:
- Enter and stay in Australia until a decision is made on your permanent Partner (100) visa application
- Work and study in Australia
- Access Medicare
Partner (Migrant) 100 Visa holders can:
- Stay in Australia indefinitely
- Work and study in Australia
- Apply for Australian citizenship after 4 years’ residence
- Sponsor eligible relatives for permanent residence
Two years after lodging a 309 Temporary Partner visa application, the 309 visa holder may be eligible to apply for a Permanent Partner (100) visa.
PROSPECTIVE MARRIAGE OR FIANCÉ (300) VISA
This visa is for those who want to come to Australia to marry their fiancé or prospective spouse who is an Australian citizen or permanent resident or an eligible New Zealand citizen.
The applicant must be outside Australia at the time of application and visa grant.
The 300 visa is usually valid for 9 months (*up to 15 months during the Covid-19 pandemic) within which the visa holder must enter Australia, then the couple can get married in any country of their choice.
