Starting 1 July 2022, there will be concessions and additional Permanent Residency pathways for specific Temporary Work (457) Legacy and Temporary Skills Shortage (TSS) (482) visa holders.
1. TSS/482 visa holders in Short-term Stream
– TSS/482 visa holders in the short-term stream will be able to apply for the 186 visa under the Temporary Residence Transition (TRT) stream of the Employer Nomination Scheme (ENS), provided they:
- have been in Australia for at least 12 months between 1 February 2020 and 14 December 2021
- apply for the 186 TRT visa from 1 July 2022 to 1 July 2024 (unless extended by law)
– The above also applies to 457 visa holders with occupations on the Short-term Skilled Occupations List (STSOL).
2. 457 visa holders will have Age Exemption
– Legacy 457 visa holders will be exempt from the age requirement (below 45 years old) when applying for the 186 TRT visa, provided they:
- have held a 457 visa on or after 18 April 2017
- have been in Australia for at least 12 months between 1 February 2020 and 14 December 2021
– No age limit has been specified for the Legacy 457 worker
– According to the Department, this age exemption is valid from 1 July 2022 to 1 July 2024 (unless extended by law)
3. TSS/482 visa holders in Short-term Stream can apply for Third TSS visa Onshore
– TSS/482 visa holders in the short-term stream can apply for a Third TSS/482 visa within Australia, provided they:
- have not held more than two short-term stream TSS visas
- have been in Australia for at least 12 months between 1 February 2020 and 14 December 2021 holding a TSS/482 short-term stream visa
- submit their application before 1 July 2023 (unless extended by law)
